New Rights to Counsel in Some Family Law Cases

On February 10, 2015, the Massachusetts Supreme Judicial Court in Guardianship of VV ruled that indigent parents in private guardianship proceedings (those where the state is not involved) have the right to court-appointed counsel. This is a further extension of the right to counsel afforded in Adoption of Meaghan, 461 Mass 1006 (2012), where indigent parents were found to be entitled to counsel in private adoption cases, just as they would be if the state were involved in the adoption.
